NOTIFICATIONS BY CENTRAL GOVERNMENT

 

SoP's for management and regulation of EPFO exempted establishments

 

On October 6, 2023, the Employees' Provident Fund Organization ("EPFO") released Standard Operating Procedure ("SoP's") for management and regulation of EPF exempted establishments. The said SoP's describe the process of compliance to be done by the exempted/relaxed establishments managing their own trust and the regulations thereof as per the condition delineated in the statue. 

 

EPFO extends 3 (three) months’ time to upload wage details

 

On September 29, 2023, the Central Board of Trustees, Employees' Provident Fund Organization ("EPFO") in view of receiving request from employers and employers’ association to extend the time period for uploading wage details of applicant pensioners / members, granted time period of 3 (three) months to submit wage details till December 31, 2023.

BIHAR

 

Minimum Wages Notification

 

On September 27, 2023, the Government of Bihar revised the minimum rates wages which shall be effective in the state of Bihar from October 1, 2023.

 

DELHI

 

Minimum Wages Notification

 

The Government of NCT Delhi vide notification F.No.(142)/02/MW/VII/Part file/5206-5224 released the Minimum Wages for scheduled industry effective from 1st October 2023.

 

Manual for Construction Workers

 

On October 5, 2023, the Labour Department of Delhi, released a safety manual for health and safety workers. The manual inter-alia includes safety and health policy; electrical safety; chemical safety; occupational health, etc.

 

HARYANA

 

Minimum Wages Notification

 

On October 3, 2023, the Government of Haryana revised the minimum rates of wages of employees engaged in certain schedule of employment, namely, loading and unloading of railway sheds, construction of roads and runways, mines, agriculture, employment of sweeping and cleaning, watch and wards and stone mines for stone breaking which shall be retrospectively effective from October 1, 2023.

 

ODISHA

 

Minimum Wages Notification

 

On October 4, 2023, the Government of Odisha revised the minimum rates of wages of employees engaged in 89 (eighty-nine) scheduled employment which shall be effective from October 1, 2023.

 

TAMIL NADU

 

Extension of ESI Act

 

On October 13, 2023, the Ministry of Labour and Employment with effect from November 1, 2023, extended the applicability of the Chapter IV, Chapter V and Chapter VI of the Employees State Insurance Act, 1948 ("ESI Act") in all the areas of Nilgiris district of Tamil Nadu.

 

Amendment in TN Shops Rules

 

On October 9, 2023, the Government of Tamil Nadu proposed draft amendments under the TN Shops Rules in the following manner –

 

(a)   Application for registration and amendment in registration to be made online together with a fee of INR 100/- (Indian Rupees Hundred) through the designated web portal of the labour department;

 

(b)  The employer of every establishment on commencement of the Tamil Nadu Shops and Establishments (Amendment) Act, 2018 furnish online, through designated portal of the labour department;

 

(c)   In every establishment, first-aid box to be provided at the rate of not less than 1 (one) box for every 150 (one hundred fifty) person or part thereof ordinarily employed and shall be maintained so as to be readily accessible during all working hours. 

 

UTTAR PRADESH

 

Extension of ESI Act

 

On October 13, 2023, the MoLE with effect from November 1, 2023, extended the applicability of the Chapter IV, Chapter V and Chapter VI of the ESI Act in all the areas of Nilgiris district of Uttar Pradesh.

 

UTTARAKHAND

 

Minimum Wages Notifications

 

On September 29, 2023, the Government of Uttarakhand revised the minimum rates of wages which shall be effective for the period from October 1, 2023, to March 31, 2024.
